1.1. This website is operated by “Immune Health”. Throughout the site, the terms “we”, “us” and “our” refer to “Immune Health”. Throughout this document, we will refer to our platform as our “Site”. “Immune Health” offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

1.2. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions (“Terms and Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

1.3. Any new features or tools that are added to the current store shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. 1.7. Our store is hosted on WordPress. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

2.1. We are “Immune Health” a digital platform that helps NZers and Australians get the help they need with all issues affecting their Immunity and well-being.  We help unlock the power of your Immune system to achieve your healthiest self.

2.2. As a healthcare service, we have to comply with all sorts of regulations, including the Food Act 2014, the Dietary Supplements Regulations 1985 and The Therapeutic Products Act 2023.

2.3. Our suppliers comply with the Good Medical Practice Guidelines (GMP). Their raw materials are authenticated before receipt (DNA tested) and endure rigorous testing protocols after arrival to fully adhere to Good Manufacturing Practices (GMPs) to ensure their integrity and are backed by supporting Certificates of Analysis.  Their finished products are tested ensuring the same potency & complete compliance as part of their routine procedure for every lot produced. 

3. Other applicable terms

3.1. You should familiarise yourself with ourPrivacy Policy which also applies to your use of our Site and sets out the terms on which we handle the data we collect from you as well as the data you provide to us.

4. Changes to these Terms

4.1. We sometimes come back to these terms to make changes and amends as our service or product offering develops. Please make sure to periodically check them for updates.

4.2. We are not responsible if the information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. 5. Access to our Site

5.1. You must be at least 15 years of age to use our Site and make any purchases.

5.2. In certain cases, we reserve the right to restrict access to certain parts of our site.

5.3. Your account information (login address, password, or any other piece of identifiable information) is strictly confidential and should not be shared with any third party. We reserve the right to disable your access to this site if we have reason to believe you have failed to comply with the provisions of these terms.

5.4 You may not use our products for any illegal or unauthourised purpose nor may you, in the use of the Service, violate any laws in NZ or Australia (including but not limited to copyright laws).

5.5 You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

6. Product

6.1. Our products are not intended to diagnose, treat, cure, or prevent any disease or afflictions. All claims made on the product labels and website descriptions are the sole responsibility of the manufacturer and not “Immune Health”.

All reviews on the site are from independent individuals and are not the views of “Immune Health” or its staff. “Immune Health” takes no responsibility for incorrect information on products or reviews.

Liability for adverse reactions or poor performance also lies solely with the product manufacturer.

7. Product expiry date

7.1. Most products supplied to you will include an expiry date which will vary depending on the product. Our policy is to not dispatch any product within three months of its expiry date unless otherwise stated on the product page or where the product is sold or as part of a clearance promotion around the sale of a product with a shorter expiry term.

8. Pricing

8.1. All prices displayed on the www.immunehealth.com website are quoted in NZD dollars and are inclusive of GST. GST is applicable to all orders delivered within New Zealand.

8.2. Sales to customers outside of New Zealand may be subject to the payment of taxes and charges in their country. These will typically be payable by you before the package is able to be released from customs or your country’s postal services provider. As these charges are outside of our control, “Immune Health” accepts no liability for the advance notice or payment of any such charges levied by your country’s customs, import, or postal authorities.

8.3. Prices for the products and services listed on the site are subject to change without any notice. We do our best to provide accurate pricing information but errors can occur from time to time. We have the right to refuse or cancel any orders placed for products incorrectly priced.

8.4 We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

8.5 We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

9. Payment

9.1. Payments can be made on our site by credit or debit card, through (PayPal), (Stripe) or by internet banking (POLIPAY).

9.2. Payments can be made directly via Internet Banking. We will give you our Bank account details, so you can go online and do a direct transfer.

9.2. Your order will not be processed until your payment has been received and processed through our system.

9.3. You must be authorised to use these details and to authorise us, or our payment service provider, to take payment in full for the items you’ve ordered including delivery fees.

10. Subscriptions/Auto-delivery

10.1. For ease and convenience for you, we offer a monthly delivery service of our supplements and programs on a subscription basis. This means that we will deliver these products to you on a recurring basis, for example, every month, three months or six months and charge your card accordingly. By purchasing a subscription product you authorise us to charge your payment card, on a recurring basis, for a specified amount at equal.

10.2 If you choose to subscribe for automatic delivery of our products, you will choose a quantity and frequency (time period). Upon placing your order for your subscription, you will initially be charged one payment for the quantity of product and shipping that you chose. After the time period that you chose has elapsed, we will charge your payment method on file and send you a new supply of the product. The quantity of product will be equal to the original quantity you chose, the payment amount will be equal to the original payment amount, and the order will be shipped.

10.3. Unless you call to cancel, we will continue to charge this amount to your payment method on file and send you a new supply of product on a recurring basis as frequently as you indicated when you defined the terms of your Auto-Delivery plan. There is no commitment and no minimum to buy. Exact shipment times may vary.

10.4. You may cancel your subscription at any time by contacting us at info@immunehealth.co.nz or texting 027 555 7080.

10.5. Should you wish to cancel your subscription, please note that you are reinvoiced 2 days before that order is due to be despatched. If you do not wish to receive a repeat on your order, you must cancel your subscription before you are reinvoiced for your repeat to ensure that you are not charged. We will send you an e-mail or text to confirm that your subscription has been cancelled and that you will no longer receive monthly shipments of our product.

10.6. Should your card expire (or fail for any other reason) and you do not provide updated payment details, we will automatically cancel your subscription. If products have already been shipped and your card charged, we will not be able to offer a refund.

11. Delivery

“Immune Health” delivers nationwide and internationally. All items are well packaged for safe delivery.

11.1. Once your order has been confirmed, payment completed and the goods are in stock your order will be despatched to you within 12 working hours.

11.2. An email or Text (SMS) will then be sent to you confirming that your order has been cleared for despatch.

11.3. We use NZ Courier Post as our preferred shipping partner. Please allow 3 days.

12.  Returns  

12.1. All of our products are backed by our 60-day money-back guarantee, less shipping.

12.2. You may return any item that is in mint unopened condition to us at your own expense and within 60 days of receipt for a refund of the purchase price of the goods.  We will notify you on receipt of your return via email and confirm when your refund has been made. Customers will be refunded by the method the order was originally paid with.

13. Cancellations

13.1. If you change your mind about an order, we can cancel and refund a submitted order for you as long as it has not been dispatched.

13.2. If you are cancelling your order because of the following reasons, we will be refunded for any product that you have not received. The reasons being:

13.2.1. A change in our terms which you have not agreed to.

13.2.2. An error in the price or product description on our site that changes your decision to purchase the product.

13.2.3. The delay in the supply of your chosen product due to events outside of our control (for example, delivery failures).

13.3. Please make sure you contact us with your order details as soon as possible. Unwanted products can also be returned for a refund within 60 days of purchase as long as they are in re-saleable condition (unopened, with undamaged packaging).

13.4. With regard to repeat orders, payment is taken 2 days before your order is meant to be sent out. You need to cancel your subscription before you are rebilled for your repeat.

14. Refunds

14.1. If you are entitled to a refund, the price paid for the products including delivery costs will be refunded to you by the same method that you used to pay. We may make some deductions from the price, as described below.

14.2. Refunds will be made once the matter is settled between our customer service team and yourself.

14.3. You should expect your refund to reach your bank account within 10 working days of it being issued.

14.4. Returned parcels by Courier:

14.4.1 If our courier returns your parcel to us for any reason, we will keep it for you for 4 weeks and contact you about rescheduling delivery free of charge.

15. Binding contract

Your use of the website, opening an account with “Immune Health”and/or the ordering of anything from “Immune Health”creates a legally binding contract between you and “Immune Health”that is subject to these Terms and Conditions.

15.1. When you submit an order to us, an email will be sent to you to confirm that we’ve received your request.

15.2. Your order will be binding once you receive the email informing you that your order has been approved and ready for despatch.

15.3. Cancellation requests after this point of time might not be possible.

15.4. We reserve the right to reject any order, in which case we will refund you if applicable as per these Terms & Conditions.

16. Reliance on information on this Site

16.1. All of the content on our Site is to be considered general information and not intended to amount to medical advice. If you are seeking medical advice, you should contact a doctor or clinician and refrain from taking any action regarding your health based on the content of this Site.

16.2. This website does not recommend or endorse any specific tests, doctors, products, procedures, opinions, or other information that may be mentioned on the Site. Reliance on any information provided by this website is solely at your own risk.

16.3. All product information is for educational purposes and we make no assurances or guarantees as to its completeness, accuracy –or whether it is up to date.

17. Your commitment to us

17.1. “Immune Health” is an online service, which means most of the time we will be communicating with you electronically or by phone. We care about you and your health, so we trust that you will be completely truthful and honest with us to enable our team to provide you with our service in line with the best medical practice and for your safety.

17.2. It’s your responsibility to ensure that:

17.2.1. You answer the medical assessment truthfully and to the best of your knowledge. If you don’t understand something, please contact us and we’ll give you any information you need. If you have any further questions, we recommend you contact your GP.

17.2.2. You pass on information to your regular healthcare provider. Any advice on our Site does not replace that of your regular healthcare provider. You should always tell your regular healthcare provider about any treatment and medication we supply. 

17.3. For your security:

17.3.1. Always read all product packaging and labels carefully before use.

17.3.2. If you purchase a supplement from us, please always check the date on the bottle to make sure it’s not out of date.

18. Our responsibility to you

18.1. We cannot accept liability for any damages which result from:

18.1.1. your failure to provide (and continuously maintain) complete, truthful, and accurate information regarding your medical health and any other information you give us;

18.1.2. your failure to follow the advice given on our Site, or to pass on relevant information to your regular healthcare provider.

19. Acceptable Use

19.1. By using our Site, you accept:

19.1.1. that our service does not replace your general healthcare provider.

19.1.2. to inform your general healthcare provider of any supplements you have been given by us.

19.1.3. To answer all medication questions truthfully, honestly, and to the best of your ability.

19.1.4. That you are responsible for speaking to your general health practitioner if you need help.

19.2. You accept to use our Site in a lawful way:

19.2.1. Agreeing not to harm or attempt to harm minors in any way

19.2.2. Not to knowingly transmit any data that can be harmful to our service (including, but not limited to: trojan horses, worms, time-bombs, keyloggers, spyware, and adware).

20. Jurisdiction and applicable law

20.1. The NZ courts have exclusive jurisdiction over any claim arising from or related to, the Services we provide to you.

20.2. We reserve the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

20.3. Our terms and conditions and any dispute or claim arising out of, or in connection with them or their subject matter or formation, including non-contractual disputes or claims, shall be governed by and construed in accordance with the law of New Zealand.

21. Entire agreement

21.1. These terms and conditions, our privacy and cookie notices, Site use policy and any document expressly referred to in this agreement constitutes the whole agreement between you and “Immune Health”.

21.2. This supersedes all previous discussions, correspondence, negotiations, previous arrangements, understanding or agreements between us relating to the use of our Site and the services made available on it.

22. Linking to our Site

22.1. We want to give everyone the tools to get the best healthcare so the more people that know about us, the better. If you do want to tell your friends or family about “Immune Health”, or link to our Site, please follow the guidelines below:

22.2. We’re proud of our reputation and will take whatever steps are necessary to protect it.

22.3. Please do not suggest any form of association, approval, or endorsement by “Immune Health”, if none exists.

22.5. If you’re unsure, please ask us before linking to our Site. We reserve the right to withdraw linking permission without notice if it doesn’t meet our guidelines.

23. Links on our Site

23.1. We sometimes link to other sites and third-party materials. These links are there for your information only and we have no control over their content. We can’t guarantee they are factually correct, nor can we accept any responsibility for any damage or loss you may suffer as a result of their use.

24. SMS/MMS Mobile Messaging Marketing Program 

“Immune Health” is offering a mobile messaging program that you agree to use and participate in. By completing the SMS/Text Messaging Opt-In or participating in any of our Programs,  you expressly consent to receive non-marketing and marketing text messages from “Immune Health”, including text messages made with an Autodialer, to the mobile phone number you provide.

24.1. How to Opt-In: The Program allows Users to receive SMS/MMS mobile messages by affirmatively opting into the Program, through online or application-based enrollment forms. Regardless of the opt-in method, by participating in the Program, you agree to receive auto dialled or pre-recorded marketing mobile messages to the phone number associated with your opt-in.

24.2. How to Opt-Out: You may opt out of these communications at any time by replying STOP to any text message from Us or by contacting “Immune Health” as indicated below.  You may receive an additional mobile message confirming your decision to opt-out.

24.3. Program Description: Without limiting the scope of the Program, users that opt into the Program can expect to receive messages concerning the marketing and sale of digital and physical products, services, and events.

24.4. Cost and Frequency: Message and data rates may apply. The Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with Us.

24.6. Age Restriction:  You may not use of engage with the Platform if you are under eighteen (15) years of age.

24.7. Prohibited Content:  You acknowledge and agree to not send any prohibited content over the Platform.  Prohibited content includes:

24.7.1. Any fraudulent, libelous, defamatory, scandalous, threatening, harassing, or stalking activity;

24.7.2. Objectionable content, including profanity, obscenity, lasciviousness, violence, bigotry, hatred, and discrimination on the basis of race, sex, religion, nationality, disability, sexual orientation, or age;

24.7.3. Pirated computer programs, viruses, worms, Trojan horses, or other harmful code;

24.7.4. Any product, service, or promotion that is unlawful where such product, service, or promotion thereof is received;

24.7.5. Any other content that is prohibited by Applicable Law in the jurisdiction from which the message is sent.

25. Warranties

25.1. As explained earlier, the Site may change, be updated, or be suspended. Therefore, we are unable to give you, and we exclude, all representations and warranties as to the accuracy and completeness of the information published on our Site. Nor can we guarantee that the material is up to date or that every service and product will be available at all times, or indeed that the Site itself will not be discontinued in the future.

25.2. We can’t be held liable and you will not be entitled to any type of compensation or other payment if the Site is discontinued if any content is inaccurate or any of our services are changed.

25.3. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

25.4 We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

To the extent permitted by law, we and third parties connected to us hereby expressly exclude any liability for any loss or damage of any nature, such as any business losses, whether direct, indirect or consequential, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill incurred by any user in connection with our Site, or in connection with the use, inability to use, or results of the use of our Site and services, any Sites linked to it and any materials posted on it, whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

26.2. Nothing in these terms and conditions limits our liability for:

26.2.1. death or personal injury arising from our negligence.

26.2.2. fraudulent misrepresentation or misrepresentation as to a fundamental matter; or
